Partner caterers charter

Canopy Festy LLC, a company governed by United States law, operates the Canopy Festy platform, which connects Hosts offering a view of major events with Visitors. This charter defines the partnership between Canopy Festy and the caterers it recommends to Hosts.

1. Purpose

Canopy Festy recommends to Hosts caterers selected for the quality of their services. In return, the partner caterer undertakes to respect the rules of the platform when preparing drinks or meals for a Reception booked on the site.

2. Free of charge and independence

The partnership is free: the caterer pays nothing to be recommended, and there is no advertising or paid ranking on the site. The recommendation is based on quality alone. The caterer remains an independent business; there is no relationship of subordination with Canopy Festy.

3. What Canopy Festy provides

Canopy Festy introduces the caterer, on request, to Hosts in the cities it serves; the listings of Hosts who work with the caterer show the mention « Canopy Festy partner caterer », without its name. Orders reach the caterer through the Host in a structured form: content of the services, choices, diets, allergies, number of people and dates.

4. Respect of the drinks and meals sheet

The caterer respects the standard content of the services defined by Canopy Festy, the choices, diets and allergies declared by the Visitor, the quantities announced by the Host and the deadline for changing choices (until the fifteenth day before the Event). These elements form part of the contract between the Host and the Visitor.

5. Compliance

The caterer holds the authorisations and registrations required for its activity, complies with hygiene rules and allergen information requirements, serves alcohol only to adults and is insured for professional liability. Each year it provides Canopy Festy with an insurance certificate.

6. Quality

The caterer answers Hosts' requests within forty-eight hours, delivers and serves at the agreed time and presents its services at a level matching the site's premium positioning.

7. Relations with Hosts

The caterer is the Host's service provider: their terms and payments are agreed directly between them. The Host remains solely responsible to the Visitor; Canopy Festy is not a party to the contract between them.

8. Non-solicitation and non-circumvention

For twenty-four months after a service linked to a Reception booked on the site, the caterer refrains from soliciting the Visitor, from offering the Visitor a service outside the site for a Reception known through the site, and from helping a Host conclude a booking outside the site.

9. Confidentiality and personal data

The caterer receives no Visitor contact details. The information it learns about orders remains confidential and is used only to perform the service, in compliance with the General Data Protection Regulation.

10. Use of the mention

The caterer may refer to its status as « Canopy Festy partner caterer » for the duration of the partnership, without altering the mention or associating it with other offers. Any other use of the Canopy Festy name requires written consent.

11. Monitoring and sanctions

Visitors' complaints relating to drinks or meals are examined with the Host and the caterer. A breach may lead to withdrawal of the mention, the end of the recommendation or termination of the partnership; proven circumvention obliges the caterer to pay Canopy Festy compensation equal to the fees and commissions lost.

12. Local rules

The laws and regulations of the country and place where the service is performed (hygiene, alcohol, allergens, authorisations, taxation) apply in all cases. Where they differ from the rules of this charter or from Canopy Festy's terms and conditions, they prevail, and the caterer complies with them.

13. Duration and termination

The partnership is concluded for one year, tacitly renewable. Either party may end it at any time with thirty days' notice, or without notice in the event of a serious breach. The non-solicitation and confidentiality undertakings survive the end of the partnership.

14. Governing law, disputes and acceptance

Between Canopy Festy LLC and the caterer, as in the terms and conditions, the charter is governed by the law of the State of the United States where Canopy Festy LLC is registered for a caterer established in the United States and, for a caterer established elsewhere, by the law and courts of the country where it is established. In all cases, the mandatory provisions of the place of the service apply.

Canopy Festy LLC is not a party to the contracts between the caterer, the Host and the Visitor. A dispute between the caterer and the Host falls under the law and courts of the Host's country. A dispute between the Visitor and the caterer, or the Host who publishes the listing and offers the meals, falls under the law and courts of the Visitor's country of residence, who keeps the protection granted by their law.

The charter is accepted online, with the date and version accepted recorded, or signed electronically.
